Payment Terms
All sales will be prepaid by credit card unless credit terms have been previously established. Interest charges of one point five percent (1.5%) per month, eighteen percent (18%) per year, will be charged on all past due accounts. Administrative fees of fifty percent (50%) will be added to the interest charges on all overdue accounts when payment is obtained though a collection agency.

All terms, conditions, and payments are in US dollars for sales in North America.

Restocking Fees
Merchandise may only be returned with permission and an RGA from Trending Accessibility. All products returned for any reason other than Trending Accessibility’s error will be subject to a 25 % restocking and handling charge of the net price of the product at dealers invoice, plus all applicable charges for labor, materials, and / or freight.
Product must be returned within 30 days of RGA or no credit will be issued. Returns cannot be processed that exceed 60 days from the Trending Accessibility invoice.

Shipping Charges
All shipping charges are FOB Pennsauken, New Jersey.

All content included in the Trending Accessibility web site, price book, brochures, videos including logos, text, images, icons, clips, data , graphics, etc is the property of Trending Accessibility LLC or the manufacturer of the products offered by Trending Accessibility.
The use of such content is prohibited without the express written consent of Trending Accessibility.

Damage or Loss
Our responsibility ends at the time Trending Accessibility delivers the merchandise in original condition to the carrier. Delivery to the carrier constitutes delivery to the customer. All claims for damaged or lost shipments must be made promptly by the customer to the carrier.

Motor Freight
All products are placed in individual boxes and placed onto a shrink wrapped pallet. The products will be shipped via common carrier (YRC, R&L, UPS Freight, etc.) using the most efficient provider based both on estimated time and price. The products can be shipped to businesses with or without a loading dock, residences, and construction sites. A person will need to be on site to inspect and sign for the shipment. Most carriers will request a 3-4 hour window for delivery. A lift-gate is required on all residential deliveries and available for commercial deliveries if needed. The driver is only responsible for placing the pallet onto the ground on residential deliveries or commercial deliveries without a dock or forklift. All destinations must be tractor trailer accessible. Shipping and handling charges cover one delivery attempt to customer. In the event that due to customer unavailability or other customer circumstance, an order is not deliverable, the customer will be responsible for additional shipping and handling charges. If there are any problems concerning the delivery please contact us as soon as possible. All shipments should be thoroughly inspected for damage by the buyer or the buyer’s designated recipient before the shipment is accepted. The buyer is responsible for all damage that occurs following receipt of the shipment.

Product Receiving Instructions:
1. Please inspect the shipment immediately upon receipt.
2. Please sign for piece count as well as pallet count.
3. The freight carrier has acknowledged the receipt of this shipment from our facilities in good condition. By your acceptance of the shipment from the carrier on the bill of lading, you acknowledge that the product has been delivered in good condition. Trending Accessibility cannot be responsible for loss or damage if you give the carrier a clean and clear receipt.
4. If any shortages or damages are discovered upon delivery, make a notation for damage and/or shortage on the bill of lading with a representative from the carrier present before accepting the order.
Freight Claims Instructions:
Unconcealed damage and/or shortage: Claims can be made only when it is indicated on the Bill of Lading at the time of delivery. Claims should be made immediately with the trucking company. The situation must then be reported by email and a phone call with direct contact to Trending Accessibility. You are required to send info regarding the pieces damaged and pictures showing the damage. No claims will be allowed without the proper paperwork signed by the Customer and the Transportation Company.
Concealed Damage: Claims must be made within 72 HOURS OF PRODUCT DELIVERY. Claims must then be made by having direct contact with the trucking company. Please also contact Trending Accessibility directly and provide info regarding the pieces damaged and pictures showing the damage.

Subject to the terms and conditions of this warranty, Trending Accessibility, (“Company”) extends a two year limited warranty to the original user (“Original User”) of our product (“Product”) against defects in material and workmanship, as long as the Original User occupies the premises upon which the Product was originally installed.
Original User: The original user will return the defective product to the company, free and clear of all liens and encumbrances, transportation prepaid, accompanied by a statement of defects and proof of purchase.
What Trending Accessibility will do: Upon return of the defective product to Trending Accessibility, Trending Accessibilities sole obligation, at its option, is to either repair or replace the product, or refund the purchase price in exchange for the product.
The company makes no other warranty other than as expressly stated herein, and all implied warranties, including any warranty of merchantability or fitness for a particular purpose, are hereby excluded.
The company’s maximum liability hereunder is limited to the purchase price of the product. In no event shall the company be liable for any consequential, indirect, incidental or special and/or punitive damages of any nature arising from the sale or use of the product, whether based on contract, warranty, tort, strict liability, patent infringement, or otherwise, even if advised of the possibility of such damages. Some local laws do not allow the exclusion or limitation of incidental or consequential damages, so the above exclusion or limitation may not apply to you. This warranty gives specific legal rights and a buyer may also have other rights which may vary from state to state.
What is not covered: the following costs, expenses and damages are not covered by the provisions of this limited warranty: (i) labor costs including, but not limited to, such costs as the removal and reinstallation of product; and (ii) shipping and freight expenses required to return product to Trending Accessibility.
The provisions of this warranty do not apply to products: (i) used for purposes for which they are not designed or intended; (ii) which have been subjected to alteration, abuse, misuse, negligence or accident, act of God, Force Majure, substitution of materials; (iii) which have been improperly stored, installed, maintained or operated; (iv) which have been used in violation of written instructions provided by Trending Accessibility (v) which have been subjected to improper temperature, humidity or other environmental conditions.
